Ballast / Displacement Ratio

A measure of the stability of a boat's hull that suggests how well a monohull will stand up to its sails. The ballast displacement ratio indicates how much of the weight of a boat is placed for maximum stability against capsizing and is an indicator of stiffness and resistance to capsize.

A measure of the weight of the boat relative to it's length at the waterline. The higher a boat’s D/L ratio, the more easily it will carry a load and the more comfortable its motion will be. The whereabouts of a former Las Vegas Democratic politician around the time a veteran investigative journalist was brutally stabbed to death remains a key question in the ex-official’s murder trial – and a newly unearthed text message shrouds mystery to the defendants alibi as he continues to plead his innocence and contest DNA evidence linking him to the crime.

Robert Telles , 47, is on trial for killing journalist Jeff German , who had penned critical stories about the official, and the defendant faced tough questioning during cross-examination on Thursday where the prosecutor presented him with a surprise text message sent from his wife that had vanished from his phone. 

Telles, a former Democratic Clark County administrator of estates, read out a text message from his wife, showing that she had wondered where he was around the time German was ambushed and killed outside his home nearly two years ago.

“It says, ‘Where are you?’” Telles said, in response to prosecutor Christopher Hamner.

Telles testified earlier that he had ignored several text, email and voice messages while he was at home, and gone for a walk and then to a gym the day German was killed.

Prosecutors have suggested that he had left the phone at home as he executed a meticulously planned fatal attack on the journalist.

Hamner zeroed in on cellphone records presented Wednesday by a defense witness that included no listing of the text from Telles’ wife.

The prosecutor said it was found on her Apple Watch device, and that the message had been deleted from Telles’ phone. 

Telles said he had been in possession of the phone all day and that he had had the ability to save and delete messages.

He did not admit that he had deleted the message.

Hamner noted the time — 10:30 a.m. on Sept. 2, 2022 — was the time security video presented earlier to the jury showed a maroon SUV that Telles had agreed looked just like his, was in German’s neighborhood.

It was driven by a person wearing an orange outfit and a big straw hat. Telles himself referred several times Thursday to that person as German’s killer.

Telles said on the stand that a professional assassin stabbed German to death.

He has accused a real estate firm of being behind the murder in order to frame him for trying to fight corruption that he saw in his office.

German was found slashed and stabbed to death in a side yard outside his home, where Telles is accused in a criminal complaint of “lying in wait” for German to come outside.

Telles was arrested days later after police circulated video of a person wearing an orange work shirt and a wide-brimmed straw hat toting a shoulder bag and walking toward German’s home. 

Prosecutors say they have strong evidence, including DNA believed to be from Telles found beneath German’s fingernails and cut-up pieces of a straw hat and shoes found at Telles’ house that resembled those worn by the person seen on video outside German’s home. 

Telles did not dispute that his DNA had been found beneath German’s fingernails but suggested that it may have been planted there.

Autopsy photos show knife or slash marks on German’s arms that police said stemmed from German’s fight for his life.

Telles said he did not know how the cut-up pieces of a straw hat and shoes had turned up in his home.

“So you hold the DNA labs in on it, too?” Hamner said.

“I don’t know. I don’t know at what point. I don’t know what point the sample was collected,” Telles responded.

“Sir, please tell us, jury. How in the world does your DNA get underneath Mr. German’s fingernails?” Hamner replied.

“I don’t know, because I did not kill Mr. German,” Telles said. 

Hamner acknowledged that two key pieces of evidence were never found: The orange work shirt and the knife used to attack German.

He wondered why people who had been out to frame Telles would have left them out of the evidence inventory.

“Why wouldn’t they put the murder weapon in your house?” Hamner asked.

“Does that make any sense?”

“I don’t know,” Telles responded.

On Monday the jury heard that Telles had hundreds of photos of German’s home and neighborhood on his cell phone and computer.

Other photos taken from Telles’ devices included an image of a single gray athletic shoe with a distinctive black pattern and a shot of Telles’ work computer at the Clark County Public Administrator and Guardian office with results of internet searches through a password-protected site that retrieved German’s name, home address, vehicle registration and date of birth.

Hamner noted previously to jurors that the photo had been taken Aug. 23, 2022 — less than two weeks before he was found dead in a pool of blood.

Police also released images of a distinctive maroon SUV like one that a Review-Journal photographer had seen Telles washing outside his home several days after the killing. 

It had been driven by a person wearing an orange outfit and a big straw hat. 

Both sides said they expect closing arguments to come Monday, two weeks after jury selection began.

Court Documents: Kohberger says he was 'out driving' the night of University of Idaho murders

New court documents released on April 17 state Bryan Kohberger, the man accused of killing four University of Idaho students in November 2022, was out driving in the early morning hours of Nov. 13, 2022.

Ethan Chapin, Xana Kernodle, Madison Mogen and Kaylee Goncalves were found dead in a home on King Street in Moscow on Nov. 13, 2022. That home has since been demolished .

The court documents say Kohberger moved to Pullman Washington in June 2022, and ran and hiked in many areas, including Wawawai Park. His running and hiking decreased after classes and work started at Washington State University, but his "nighttime drives increased," wrote public defender Anne C. Taylor in the document.

An affidavit was written after the murders by Brett Payne, a corporal with the Moscow Police Department. The affidavit was released to the public in March 2023, after Kohberger was arrested in Pennsylvania and brought back to Idaho.

The document had many details, including information from the two surviving roommates in the home, DNA evidence from a knife sheath located near one of the victims bodies, and cell phone data and video footage.

The court document from April 2024 states there is data from Kohberger's phone that shows him in the countryside "late at night and/or in the early morning on several occasions." Taylor goes on to write the phone data includes photos taken on different evening and early mornings, including in November, showing the night sky.

According to the affidavit, camera footage showed a white sedan, believed to be Kohberger’s, traveling west on Indian Hills Drive in Moscow at around 3:26 a.m. and west on Styner Ave. on Idaho State Highway 95 in Moscow at around 3:28 a.m on Nov. 13, 2022.

The forensic examiner initially believed the vehicle to be a 2011-2013 Hyundai Elantra, but upon further review, it was indicated it could also be a 2011-2016 Hyundai Elantra. In this video, police say it appeared the vehicle did not have a front license plate.

A review of more footage from multiple videos showed several sightings of the Elantra starting at 3:29 a.m. and ending at 4:20 a.m. The videos show the vehicle making three initial passes, then entering the area a fourth time at around 4:04 a.m. The Elantra is next seen leaving the area of the King Road residence at around 4:20 a.m. at a high rate of speed, according to the affidavit.

Taylor wrote in the recent court document that Kohberger was out driving in the early morning hours of Nov, 13, 2022, throughout the area south of Pullman and west of Moscow, including Wawawai Park.

The document says Kohberger plans on offering testimony from Sy Ray, a cell tower, cell phone and other radio frequency expert as a "partial corroboration." This testimony will show that Kohberger's cell phone did not travel east on the Moscow-Pullman Highway in the early morning hours of Nov. 13, and thus could not be the vehicle captured on video along the Moscow-Pullman highway near Floyd’s Cannabis shop."

Police obtained a search warrant for historical phone records for the number Kohberger gave police after a previous traffic stop before the students were killed.

According to the affidavit, that phone number stopped reporting to the network at 2:47 a.m. the morning of the murders, consistent with the phone being in an area without coverage, the connection is disabled (like putting the phone in airplane mode) or the phone is turned off. The number doesn’t report to the network again until approximately 4:48 a.m.

"Additional information as to Mr. Kohberger’s whereabouts as the early morning hours progressed, including additional analysis by Mr. Ray will be provided once the State provides discovery requested and now subject to an upcoming Motion to Compel. If not disclosed, Mr. Ray’s testimony will also reveal that critical exculpatory evidence, further corroborating Mr. Kohberger’s alibi, was either not preserved or has been withheld," wrote Taylor in the court document.

A court date has not been set for the trial. Latah County Prosecutor Bill Thompson asked the court after the King Road home was demolished to schedule a jury trial in the summer, to avoid disrupting the school year. In his filing, Thompson wrote he expects the trial could take around six weeks.

BOISE — The defense for Bryan Kohberger, who is accused of the University of Idaho student homicides, rejected arguments from prosecutors that Moscow remains an acceptable place for the suspect to receive a fair trial next summer.

Elisa Massoth, one of Kohberger’s attorneys, continued the push to move their client’s capital murder trial 300 miles south to Boise. The North Idaho region has been tainted by intense media coverage of the case, she wrote, which has created a “mob mentality within the community” about Kohberger’s possible culpability.

“The traumatized town of Moscow is understandably filled with deeply held prejudgment opinions of guilt,” Massoth wrote in a Monday court filing made public Tuesday. “Latah County mob mentality will never produce a (jury pool) that results in a cross section of the community.”

The defense backed its preference for a venue change to the Idaho capital for the trial with results from a phone survey conducted by a hired trial consultant. They supported it with analysis from a University of Nevada, Reno, social psychologist, whom they may also call as an expert witness at a court hearing next week over the venue change question before Judge John Judge.

Kohberger, 29, is accused of killing the four U of I students at an off-campus home in November 2022. The victims were seniors Madison Mogen and Kaylee Goncalves, both 21, junior Xana Kernodle and freshman Ethan Chapin, both 20. Kohberger was arrested on suspicion of the violent crime in late December 2022 at his parents’ home in eastern Pennsylvania , where he grew up.

Kohberger is charged with four counts of first-degree murder and one count of felony burglary. Prosecutors plan to seek the death penalty for Kohberger if he is convicted. A court hearing over possible challenges to the death penalty is tentatively scheduled for early November.

Prosecutors last week submitted their written opposition to the defense’s request to move the trial outside of Latah County. County Prosecutor Bill Thompson, who is leading the prosecution of Kohberger, said the defense had failed to meet the burden under Idaho law to show that a venue change was “necessary or convenient.”

“Even if the court were to be persuaded that a fair and impartial jury could not be empaneled in Latah County, the court could … draw upon a jury pool from a neighboring county,” Thompson wrote . He suggested selecting a jury from nearby Nez Perce County and driving them in for Kohberger’s trial.

Prosecutors also argued that the “interest of justice” for keeping the trial in Moscow should consider the families of the four victims, who may seek to attend the trial.

The defense responded that the state’s proposal to bring in jury prospects from the county directly south still would be insufficient for achieving an impartial group of people to serve as jurors with their client’s life possibly on the line. Ada County, with its much greater population, grants Kohberger’s best chance at a fair trial, they wrote.

“Expanding the jury pool to Nez Perce County is not a remedy,” the Monday filing read. They “have been exposed to 36% of the total media coverage and are more than 10 times more likely to encounter coverage as compared to residents of Ada County.”

That media coverage — in print, online, as well as on television and the radio — “is often inaccurate and inflammatory,” the defense wrote, without providing specific examples. The sheer amount of coverage in the closely watched case is disqualifying of Moscow hosting the trial, they wrote.

“The media coverage inundating Latah County does not tell citizens that no evidence has been presented at this time; that there are no facts on the record at this time; that Bryan Kohberger is innocent,” Monday’s court filing read. “Publicity regarding Mr. Kohberger has been ongoing since Dec. 30, 2022. It rises and falls but does not wane.”
