OFFER PROCEDURES

Offers are accumulated weekly through each Monday at 4:00 PM ET. In the event a particular Monday is a Federal Holiday, the deadline is extended an additional 24 hours. The high offer on a particular vessel is submitted to the Seller for consideration the following business day. The Seller, at its sole option, may accept or reject with or without a counter offer. Responses typically occur within 48 hours, no response constitutes a rejection of theoffer.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 1 business day to deposit into National Liquidators escrow account, the greater of 10% of Gross Offer or $1,000.

Upon notification of acceptance of an offer (either verbal or electronic), successful Bidder has 5 business days to complete any and all conditions listed above in the “Conditions Of Offer”. In any case, any remaining amounts due must be deposited into National Liquidators escrow account, within 5 business days after notification of acceptance of an offer (either verbal or electronic). Successful Bidder’s failure to fund the total offer price within 5 business days after notice of acceptance will result in forfeiture of any deposits. In these instances, the vessel will be placed back into the auction cycle.

After funding the total offer price, Successful Bidder must remove the purchased vessel from National’s storage facility within two business days or make storage arrangements with National. Storage charges will accrue on ALL purchased vessels until each is removed from National’s storage facility. Standard storage rates apply; refer to http://www.yachtauctions.com/services for currentrates.

All vessels are sold AS IS, WHERE IS, with no warranties or representations, express or implied, as to condition or fitness for a particular purpose.

NOTICE REGARDING TITLING OR US COAST GUARD DOCUMENTATION

National Liquidators makes no guarantees, representations or warranties as to title or the ability to document or register the vessel. National Liquidators are acting as a broker only and issues as to title, documentation and registration are between the Buyer and the Seller, owner or lien holder. The required $399.00 administrative fee covers National’s efforts to obtain titling and documentation information from the Seller; it does not include transfer of title or documentation to Buyer. National Liquidators can process transfer of title or documentation to Buyer an additional fee. Buyers that are interested in this service can contact National’s title department for details, including charges. Ohio Law requires National to transfer title (not USCG documentation) directly to Ohio residents only, a $150 fee is charged for this service.

Boat Liquidators

All you need to know about boat liquidation.

When seeking a boat for sale, you may wish to consider a boat liquidation sale. Boat liquidation auctions are the result of boats which have been repossessed by the investor, usually the financial lender, and require immediate sales in order to offset the loss that the financers would obtain if the vessel was not sold. While this is unfortunate for the original purchaser of the boat, it does offer an ideal opportunity for qualified buyers to obtain the boat of his or her dreams for a fraction of the cost. However, before you attend a boat liquidation sale there are a few things that you should know.

Boat liquidators are in the business of obtaining capital quickly for the boat which was repossessed. In many instances, the bank or the lender will not take the time to have a full inspection of the vessel, but will just ensure that the boat can operate without sinking. As such, anyone who purchases a boat from a liquidation sale should be cautious of problems with the starter, the electrical system, outboard motors, and such.

Repo boats are sold as-is. This means that there are no warranty or guarantees to the boats. It is a coin toss that plays to the gambler nature and the deal seeker side of the business. This is not to state that liquidations are a bad thing, but rather that the purchaser should note that the reason that the boat is discounted is to avoid having to pay for inspections and (depending upon the repo company you choose) sea tests.

What is the history of the boat?

It is critical that when you go to a liquidation sale that you ask the seller about the history of the boat. Sometimes, not often, boats at repo sales will be police repossessions of stolen and stripped boats. While there may be an effort to spruce up the boat, there could be vital elements missing. Additionally, if a dealership is selling a boat as liquidation, the potential buyer should inquire as to the history of the boat. Has the boat been dry docked for a long time? Has the boat been wrecked? How many miles does the engine have upon it? All these questions should be asked prior to purchasing the vessel.

Just a little bit of work

Your inquiries into the boat’s history may yield the answer that the boat for sale needs minimal handyman work. Be cautious. While there could only be some minor cost involved in the “fix-up” process, the boat is being sold as-is and the repairs could become substantial. Think of it in terms of doing a rebuild on a house. There are always hidden costs, unforeseen problems, and fees that are not calculated in. Additionally, if you are purchasing an older model boat liquidation, parts may not be available or may be rather pricy, depending upon the model.

The Good side to boat liquidators

Not all boat liquidators are bad. There are many instances where you will be able to find a great deal on a boat through an auction or a repossession. It is advised that you choose a boat from a creditable source, and that you perform due diligence in inspecting the boat. Sales tax exemptions will be accepted on non-titled assets with a copy of your current agricultural and/or tax exemption certificate as long as that item pertains to your business and is for resale only. Sales tax exemption will be accepted on tilted vehicles only with a current tax exemption certificate and dealer's license. All out of state buyers must pay taxes in Florida and will be required to fill out an affidavit for their home state. Out of country buyers are tax exempt only with a copy of the bill of lading during check out. 

4    - INSPECTION: Items will be available for inspection beginning 2 days prior to the sale from 9:00 AM to 4:30 PM, or sale day morning starting at 7:30 AM. 

5    - SALE SITE DIRECTIONS 2738 Gall Blvd. Zephyrhills, FL 33541. From I-75 take exit 275 then go East on State Road 56 for 13.5 miles to its end at Highway 301 (AKA Gall Blvd). Cross Highway 301 and the auction will be on your right.  

6    - TERMS: Payment in full is required by the Wednesday after auction day, by cash, credit card, certified funds, or check with a bank letter of guarantee. Sample letter of guarantee: "We hereby guarantee the payment of our customer written on his account up to dollars for purchases at your auction sale on." Personal and Business checks are accepted on sale day however, assets will be held at auction yard for 5 business days or until the check clears, whichever is later. All checks should be made payable to Royal Auction Group Inc. Wire transfers are acceptable if approved at time of registration. ALL invoices will be accessed with a $25.00 processing fee. Most major credit cards are accepted up to $5000.00 with a 3.5% surcharge added into the amount collected.     Winning bidders are required to contact Royal Auction Group via email at  [email protected] to arrange payment instructions on sale day. New and online bidders may be required to submit a minimum of $500 security deposit. The deposit is refundable if no items are won. Any attempt to circumvent this authorization will be considered theft by deception and the buyer will be prosecuted to the fullest extent of the law. Buyers shall not be permitted to possess any of his purchases, and title to such purchased items will not be delivered to the buyer, until the TOTAL PURCHASE PRICE of all his purchases including all applicable goods, taxes or fees have been paid. 8    - REMOVAL: No items may be removed until paid in full. Except as  otherwise set forth in section 6 above, all sale items that can be carried by hand may be removed on sale day as long as the removal activity is not disruptive to the sale and only until 5:00 PM. All items may also be removed Monday through Friday, 9:00 AM to 4:00 PM, and all items must be removed by 10 business days after the posted sale date. A $20/day per item storage and transportation fee will incur if items are not removed by posted deadlines. Items not removed in the time frame listed above may be deemed abandoned, and the auctioneer may tow and impound or resell the lot.  It is solely the responsibility of Buyer to remove all items within the time frames set forth in this Section. 

9    - AIRPORT: The area is serviced commercially by Tampa International Airport (TPA)

10    - LOADING: RAG staff will gladly assist in loading purchases. RAG only has access to a 5,000lb forklift and cannot lift items with a weight greater than that. Our staff will not load or tie down purchases, but merely will aid the buyer in the process. We are not responsible for any items loaded or any securement of such items. If an outside transport company is used, make sure the driver can load and tie down on their own. In no way will RAG or any of its employees be held responsible for any damage or injury to such items or to any other persons or property during the loading process, and Buyer assumes all risks of damage to the items following the winning bid by any cause, including Acts of God. If the item is listed as non-running, plan to bring a tow truck. We will not push vehicles onto a trailer. Buyer agrees to indemnify and hold RAG and its staff harmless from any claims of damage or injury to any items or to any other persons or property during the loading process. 

11    - TITLE PROCESS — RAG will handle all title transfers. Please bring proof of insurance and appropriate funds for your transfer and registration fees. Dealer fees apply to all titled vehicles, ATVs, and Trailers over 2,000 lbs. The title transfer documents can be done in person, or you can opt for electronically signing the documents. 13    - LITIGATION: Costs and Expenses. In the event of any litigation between any of the Parties arising from or relating to the enforcement or interpretation of this Agreement, the prevailing party is entitled to recover all costs and expenses, which shall include attorney's fees incurred at all proceedings, including, without limitation, before trial, at trial and all appellate levels, against the non-prevailing party. In any such award of costs and expenses, the prevailing party shall also be entitled to recover "fees on fees" from the non-prevailing party, meaning those costs and expenses, including attorney's fees, which are required to determine the amount of costs and expenses to be awarded 

14    - GOVERNING LAW, JURISDICTION, and VENUE: This Agreement shall be deemed to be made and entered into in the State of Florida, and shall, in all respects be interpreted, enforced, and governed under the laws of Florida. The sole and exclusive venue and forum for any litigation arising under or related to this Agreement shall be the State Courts of Florida located in Hillsborough County, and the parties hereby expressly waive and release any rights they may otherwise possess to file or move any such litigation to any other Court in the State of Florida, or to any Court in any other State, or to remove such litigation to Federal Court.    15    — CONSIGNORS: No consignor is permitted to bid on their own item(s), and a consignor bidding on their own items will be deemed in breach of this Agreement and their Consignment Agreement. It is acknowledged that a consignor bidding on their own items will cause RAG to incur costs and damages that are difficult to ascertain with certainty, therefore a consignor bidding on their own items shall be liable to RAG for 20% of the sale price or reserve amount as liquidated damages. Such liquidated damages are intended to represent estimated actual damages and are not intended as a penalty. In addition, RAG reserves the right to preclude any consignor bidding on their own item(s) from consigning again. 

16    - Royal Auction accepts absentee bids for bidders that cannot physically attend the auction. Absentee bids are treated similar to a max prebid on Proxibid or Equipment Facts. Absentee bids are accepted through a Docusign agreement. Please contact the auction site for details on this process. 

17    - Royal Auction accepts consignments that may be sold OUTSIDE of our physical host auction site. These items will have a lot number followed by a two letter state identifier of what state the item is located. Additionally, the description will describe the state and city where the item is and will have to be removed from.

Auction Terms Glossary:  Odom Reads – This is what the odometer shows at the time of check in. Odom reads is not a guarantee of true mileage, we are simply stating what the odometer is currently showing.    One Owner Fleet – Means this item has had only one previous owner/user. The unit may have changed hands through a dealer but has had only one true owner/user.    City of XXXX – Unit has previously been owned by the City or County named here.    Pwd by/Pwr by – Means the unit has this brand or size power unit.    Limited Function Check – Means during our short check in period, we performed a limited function test of major components where the results are written in the description. Same boat that hit Matanzas Pass Bridge on Monday, blocking traffic, taps bridge Tuesday

A day after a shrimp boat struck one of the only two bridges to Fort Myers Beach , closing it for several hours, officials say the same vessel again came into contact with the structure Tuesday.

Christine Gala, 71, a Fort Myers resident of 60 years who has owned  Trico  Shrimp Company, said this was the first vessel they purchased since Hurricane Ian on Sept. 28, 2022, stripped them from the 14 boats they had then.

The boat, Capt. Jack II , was just recently purchased by Gala , who said it was making its way from Texas. She said they hope to rename it Big Daddy, dubbed after Big Daddy's Seafood Market, on Fort Myers Beach.

"We were thrown into retirement immediately," Gala said of the hurricane's impact. "It's a slow process."

In order for Capt. Jack II to make it past the Matanzas Pass Bridge, Gala said, it will require cutting between 8 and 9 feet off the outriggers. After they could not make entry Monday, Gala said, they waited for a lower tide, expecting it Tuesday morning.

According to the Florida Department of Transportation, the boat's outrigger contacted the Matanzas Pass Bridge. Authorities said the shrimp boat then backed away.  

Officials said a Lee County marine unit reported no visible damage to the bridge, which remained open Tuesday morning.

The Florida Department of Transportation on Tuesday dispatched a bridge inspection team to assess the bridge and document any damage.

Around 12:30 p.m. Tuesday, officials with the Florida Department of Transportation said, they completed their inspection of the Matanzas Pass Bridge and confirmed Tuesday's damage caused by the shrimp boat was limited to scrapes to the paint on the outside beam.

The U.S. Coast Guard, Lee County Sheriff’s Office and the Captain of the Port are aware of these findings, officials said.  

Matanzas Pass Bridge closed for hours Monday

No one was injured Monday after the commercial shrimp boat crashed into the Matanzas Pass Bridge, closing the bridge for a few hours.

The Lee County Sheriff's Office  posted on X  shortly after noon, alerting the crash closed all travel lanes on the bridge after the vessel hit the structure. Fort Myers Beach fire announced around 2:40 p.m. Monday traffic was again allowed.

The sheriff's office assisted the Florida Department of Transportation, as well as the U.S. Coast Guard, while they assessed damages.

After nearly two hours, authorities reopened the bridge to traffic.

Florida-based Tupperware Brands seeks Chapter 11 bankruptcy

Tupperware Brands, the company that revolutionized food storage decades ago, has filed for Chapter 11 bankruptcy protection.

Orlando, Florida-based Tupperware plans to continue operating during the bankruptcy proceedings and will seek court approval for a sale, “in order to protect its iconic brand,” the company said just before midnight on Tuesday.

The company is seeking bankruptcy protection amid growing struggles to revitalize its business. Tupperware  sales growth improved some  during the early days of the COVID-19 pandemic, but overall sales have been in steady decline since 2018 due to rising competition. And financial troubles have continued to pile up for the company.

Doubts around Tupperware’s future have floated around for some time. Last year, the company sought additional financing as it warned investors  about its ability to stay in business  and its risk of being delisted from the New York Stock Exchange.

The company received an additional non-compliance notice from the NYSE for failing to file its annual results with the Securities and Exchange Commission earlier this year. And Tupperware had continued to warn about its ability to stay afloat in more recent months, with an August securities filing pointing to “significant liquidity challenges.”

In Tuesday’s bankruptcy petition, Tupperware reported more than $1.2 billion in total debts and $679.5 million in total assets. Shares for the company have fallen 75% this year and closed Tuesday at about 50 cents apiece.

“The reality is that the decline at Tupperware is not new,” Neil Saunders, managing director of GlobalData, said in Wednesday commentary. “It is very difficult to see how the brand can get back to its glory days.”

Saunders explained that many consumers have been migrating to cheaper home storage brands — noting that competition has intensified over years, particularly with the rise of online platforms like Temu and retailers like Target also beefing up their own home storage and kichenware brands.

Tupperware’s roots date back to 1946. According to the company’s website, shortly after the Great Depression, chemist Earl Tupper found inspiration while creating molds at a plastics factory — setting out on a mission to create an airtight seal for a plastic container, similar to that on a paint can, to help families save money on food waste.

The brand experienced explosive growth in the mid 20th century — particularly with the rise of Tupperware parties, first held in 1948. Tupperware parties notably gave many women a chance to run their own businesses out of their homes, selling the products within social circles.

The system worked so well that Tupperware eventually removed its products from stores. And in Tuesday’s bankruptcy announcement, the company maintained that there were no current changes to Tupperware’s independent sales consultant agreements.

According to court documents published Tuesday, Tupperware currently employs more than 5,450 employees across 41 countries — and additionally partners with global sales force of over 465,000 consultants who sell products on a freelance basis in nearly 70 countries.

Tuesday’s announcement also pointed to aims to “further advance Tupperware’s transformation into a digital-first, technology-led company,” possibly signaling a move toward increased reliance of sales on the brand’s website or perhaps more online-focused marketing, although the company did not provide exact specifics.

In a statement, Tupperware President and CEO Laurie Ann Goldman acknowledged Tupperware’s recent financial struggles and said that the bankruptcy process is meant to provide “essential flexibility” as the company pursues this transformation. She also maintained that the brand wasn’t going anywhere.

“Whether you are a dedicated member of our Tupperware team, sell, cook with, or simply love our Tupperware products, you are a part of our Tupperware family,” Goldman said in a statement. “We plan to continue serving our valued customers with the high-quality products they love and trust throughout this process.”

Goldman, who previously served as CEO of Spanx, was appointed as Tupperware’s CEO in October 2023 — as part of larger leadership change ups. The company has appointed a new management team within the last year.
