Captain, 2 crew members from Mike Lynch's family yacht reportedly under investigation over sinking off Italy

Rome — The engineer and a sailor from the crew of the luxury superyacht that sank off the coast of Sicily , killing British tech entrepreneur Mike Lynch and his 18-year-old daughter along with five other people, have been placed under investigation by Italian prosecutors along with the captain of the vessel, according to the Reuters and ANSA news agencies. CBS News could not immediately reach the prosecutors or lawyers for the Bayesian yacht's crew members to confirm the development, which comes about a week and a half after the vessel capsized on Aug. 19.
Engineer Tim Parker Eaton and sailor Matthew Griffiths, who was on night watch duty when the incident occurred, were reportedly placed under formal investigation for possible manslaughter and culpable shipwreck a few days after the 184-foot Bayesian yacht's captain, James Cutler, whose lawyers have confirmed that he's a subject of the probe.
After meeting with prosecutors for several days, Cutler, a 51-year-old New Zealander, has declined to answer any further questions, his lawyer said Wednesday.
"The captain exercised his right to remain silent for two fundamental reasons," attorney Giovanni Rizzuti told reporters. "First, he's very worn out. Second, we were appointed only on Monday and for a thorough and correct defense case, we need to acquire a set of data that at the moment we don't have."
Lynch and his daughter Hannah, 18, were among the passengers and one crew members who died when the superyacht sank rapidly during a violent storm in the pre-dawn hours of Aug. 19. The capsize of the high-tech vessel quickly raised questions, as another sailboat that had been anchored nearby off the coast of Palermo made it through the storm unscathed.
Fifteen people, including Lynch's wife Angela Bacares, escaped to a life raft and were rescued by another boat that had been in the vicinity.
According to reports by Italian media, investigators are looking into whether the engineer, Eaton, might have neglected to activate security systems designed to automatically close all the hatches on the vessel, leaving the engine room to flood and possibly causing a power outage and the subsequent rapid flooding of the entire yacht.
Under Italian law, being placed under investigation does not necessarily mean formal charges will follow.
During a press conference on Saturday, prosecutors said the investigation would require the wreck of the Bayesian to be salvaged from the seabed, where it currently sits at a depth of about 160 feet.
Chief prosecutor Ambrogio Cartosio said his team would work to determine whether the captain, other crew members, or the yacht's manufacturers bear any responsibility for the sinking.

Former Microsoft boss’ $15m superyacht spotted at Port of Aberdeen
The yacht belongs to Nathan Myhrvold, Microsoft's former chief technology officer.
A $15m superyacht owned by tech boss Nathan Myhrvold has berthed at the Port of Aberdeen this week.
The impressive vessel was spotted docked along Regent Quay in the North Harbour, its sleek design standing out against other larger work vessels docked.
Named Teleost the 160ft yacht was built in 1998 at a cost of $15m by renowned shipbuilders Feadship.
The interior is tastefully decorated and incorporating the 90s aesthetic with plush furnishings and dark wood panelling.
Some unique features included two tenders on the back as well as a hot tub on the fly bridge.
The yacht can reach a top speed of 15 knots.
Owner Nathan Myhrvold was a prominent figure at Microsoft during the 1980 and 90s culminating in his position as Chief Technology Officer in 1996.
In 2000 he started a new company called Intellectual Ventures which deals with patents, which has become very lucrative.
The tech boss is now worth more than $700m.
Teleost is the second superyacht to make an appearance in Aberdeen following the Elysian, a £66m craft owned by John W Henry – a major shareholder in Liverpool FC.

The captain of a superyacht that sank during a storm off Sicily last week, killing seven people, decided not to respond to prosecutors’ questions on Tuesday, his lawyer has said.
James Cutfield, a 51-year-old New Zealand national, is under investigation for possible manslaughter and culpable shipwreck charges and was questioned for the third time by the Termini Imerese prosecutors on Tuesday.
“He just exercised his right to remain silent, probably prosecutors were expecting that,” lawyer Aldo Mordiglia told The Associated Press, adding that the captain’s legal team has just been named and needs time to work on his defensive strategy.
Cutfield was among 15 survivors of the August 19 sinking that killed British tech magnate Mike Lynch, his daughter Hannah and five others.
Chief prosecutor Ambrogio Cartosio, who’s heading the investigation, has said his team would consider each possible element of responsibility including those of the captain, the crew, individuals in charge of supervision and the yacht’s manufacturer.
The Bayesian, a 56-meter (184-foot) British-flagged luxury yacht, went down near the Mediterranean island in southern Italy. Investigators are focusing on how a sailing vessel deemed “unsinkable” by its manufacturer, Italian shipyard Perini Navi, sank while a nearby sailboat remained largely unscathed.
Prosecutors said the event was “extremely rapid” and could have been a “downburst” — a localized, powerful wind that descends from a thunderstorm and spreads out rapidly upon hitting the ground.
The crew was saved, except for the chef, while six passengers were trapped in the hull.
What we know about the sinking:
The Bayesian, a British flagged 56-metre (184-feet) superyacht, was anchored off the port of Porticello, near Palermo, when it sank in the pre-dawn dark amid a very severe and sudden weather event.
Prosecutor Raffaele Cammarano said on Saturday the event was most likely a “downburst”, a very strong downward wind that is an intense but relatively frequent event at sea, rather than a waterspout which involves rotating winds like a tornado.
The coast guard said that given the weather forecast, there was nothing wrong about the Bayesian being moored offshore rather than at sheltering at port. Another yacht anchored nearby emerged from the storm unharmed.
Twenty-two people were on board, and 15 survived, including nine out of 10 crew members as well as Lynch’s wife, whose company owned the Bayesian. They were found on a life raft. Six out of the 12 passengers died. Prosecutors, who have put the yacht’s captain James Cutfield under investigation for manslaughter and shipwreck, said the ship would have to be pulled out of the water before the investigation could be concluded.
Stern went down first
The Bayesian sent its last signal before sinking via the tracking Automatic Identification System (AIS) at 0206 GMT, according to the MarineTraffic website.
Chief Prosecutor Ambrogio Cartosio said a red flare alerting rescue services about the emergency was fired into the sky at 0238 GMT, more than 30 minutes after the boat had gone down.
The head of Palermo’s Fire Brigade, Girolamo Bentivoglio Fiandra, said the boat sank from the stern and is lying on its starboard side at a depth of around 50 metres (164 feet).
In the yacht, the bodies of the dead were found in the cabins on the left-hand side of the boat, where the passengers may have tried to search for remaining bubbles of air, he added.
Prosecutor Cammarano said the passengers were all probably asleep at the time of the storm which was why they failed to escape.
The sinking has puzzled seafarers and nautical engineers, who have said that it should have taken hours for the Bayesian to fill up with enough water to sink it, making its swift demise incomprehensible.
There have been suggestions that one or more portholes, windows or other openings may have been inadvertently left open by the crew, or broken or smashed by the storm, letting in water.
Experts also wondered if the yacht had been moored with its keel up, potentially compromising its stability. The keel is a fin-like stabilising structure under the hull, which can be partially lifted to reduce the depth of the boat in shallow waters or harbours.
Prosecutors have said it was too early to comment on either hypothesis. They also said crew members were not immediately tested for alcohol or drugs because they were in a state of shock when rescued.
The Bayesian was built in 2008 by Perini Navi, an Italian luxury yacht maker. It featured the world’s tallest aluminium mast, measuring 72 metres, but early reports that the mast broke in the storm have so far proven unfounded.
Giovanni Costantino, CEO of the Italian Sea Group, which owns Perini, said the yacht was “one of the safest boats in the world” and basically unsinkable.

A £66 million superyacht belonging to Liverpool FC owner John W Henry has been spotted off Broughty Ferry.
Elysian, a 66-metre-long vessel, docked in the Tay – between Broughty Ferry and Tayport – on Monday morning.
It travelled to the Tay from Aberdeen, where it was berthed over the weekend.
Locals said those on board the luxury yacht appeared to be using a smaller boat to reach the shore.

It is understood Henry was among them.
The yacht has since moved out towards Barry Buddon.
One onlooker said: “I think it belongs to the owner of a Premier League football team as I’d read it was up in Aberdeen yesterday .
“We were walking along the beach this morning when we spotted it.
“You think they’d rather be in the Mediterranean at this time of year with a boat like that.”
Elysian’s arrival in the Tay was mentioned by Liverpool fan group KopTalkTV on YouTube .
In the video, the host said: “Don’t assume that he is in the UK just because the yacht’s in the UK.
John Henry’s superyacht spotted off Broughty Ferry after Liverpool game
“Maybe if you see him at the game then he’s obviously there, and what happened – he turned up at the game .”
The reason for the visit has not been confirmed but some locals have speculated Henry may be heading to the Old Course in St Andrews.
The yacht, which sails under the Cayman Islands flag, was built in Germany.
With a top speed of 16.5 knots, it has an outdoor swimming pool, helipad, spa centre and gym and glass lift.
There is room on board for up to 12 guests and 17 crew.
Previously named Ester III, the yacht was once owned by Russian entrepreneur Georgy Bedzhamov.
American businessman Henry – who also owns the Boston Red Sox and Pittsburgh Penguins – bought the ship in 2016.

First Damen Sea Axe 6911 is launched, christened Intrepid
Damen 's largest ever yacht support vessel, the 69 metre Sea Axe 6911, has been launched and christened Intrepid .
The Sea Axe range is built in cooperation between Amels and its parent company Damen . The Sea Axe 6911 is an evolution of the current flagship, the 67.15 metre Sea Axe 6711, of which two are launched, including Garcon .
Modeled after Damen’s high-speed patrol and offshore support vessels, the Sea Axe range is the ultimate superyacht toy box, designed to shadow the mothership and carry everything from helicopters to boats and submarines to extra staff.
According to Amels, client feedback inspired the Sea Axe 6911. “The owner’s team came to us with a lot of client-specific customisations for what was then our 67-metre platform,” says Damen product director Mark Vermeulen. “They put a lot of thought into how the owner would like to operate the yacht support vessel in combination with the mother yacht… Now we’ve put a lot of that client feedback into the updated design – the Sea Axe 6911.”
The current 67 metre yacht was expanded to make room for a helicopter hangar. “Now the helicopter can go into the sunken helicopter garage,” says Victor Caminada, describing how the helipad opens to allow the helicopter to take haven.
The new Sea Axe 6911 also boasts a helicopter workshop, dive centre, 110 square metres of storage below decks and 250 square metres of deck space for tenders and toys. There are accommodations for 22 crew or staff.
